Clients often ask what they should do about their injury during their case. The most important thing for you to do is take care of yourself. Not only is this a smart idea in regards to your health, it is also required by law. While pursuing a personal injury case, you are required by law to “mitigate” your damages. Therefore, you must do everything you can to get better because if you don’t, you may be accused of allowing your injury to get worse in order to get a better claim.
With that in mind, we recommend you do the following:
- Keep seeing your doctor regularly. If the doctor has record of you skipping appointments, it may be used against you while negotiating settlement or at trial. If you know you won’t be able to make an appointment, notify your doctor as early as you can.
- Remember to take any medication your doctor prescribes and follow his instructions for taking that medication as closely as possible. This is extremely important because evidence that you have not been properly taking your medication can be used against you in court.
- Actively participate in treatment. This includes any physical therapy your doctor thinks you need for soft tissue injuries. Not only can therapy help alleviate the pain and suffering caused by your injury, documentation of you regularly going to therapy can provide evidence of that pain and suffering. You should provide as much advance notice as you can if you need to miss a therapy session.
- Follow your doctor’s instructions. Follow any recommendations he has about caring for your injury while at home. If he tells you to avoid certain activities, do so. If he tells you to take time off work, do so. You may be worried about the money you’ll lose from taking time off work, but it is all but guaranteed that you will lose even more money by slowing down your recovery.
